ARTICLE 1 - RIGHT OF WITHDRAWAL

  1. When purchasing products, the consumer has the option to dissolve the agreement without giving reasons for 14 days. This 14-day period starts on the day after receipt of the product by or on behalf of the consumer.
  2. During this 14-day period, the consumer will handle the product and packaging with care. The consumer will only unpack the product to the extent necessary to assess whether they wish to keep the product.
  3. If the consumer takes actions that go beyond what was necessary to assess whether or not the consumer wished to retain the product, and thereby causes damage to the packaging or the product, the consumer will be obliged to compensate for the reduction in value. The entrepreneur may use the price or a portion thereof to cover the established reduction in value.
  4. If the consumer exercises their right of withdrawal, they will return the product with all supplied accessories and in its original condition and packaging undamaged to the entrepreneur, if applicable in accordance with the reasonable and clear instructions provided by the entrepreneur.

ARTICLE 2 – COSTS IN CASE OF WITHDRAWAL

  1. If the consumer exercises their right of withdrawal, they will bear at most the costs of return shipment. If the consumer has damaged the packaging, and/or the product and/or its contents, they are obliged to fully compensate for this damage.
  2. If the consumer has paid for delivery, the entrepreneur will refund this amount as soon as possible, but no later than 30 days after receipt of the product and packaging by the entrepreneur, possibly with deduction of delivery costs. This is provided that the consumer has not damaged the packaging, and/or the product and/or its contents.

ARTICLE 3 – EXCLUSION OF THE RIGHT OF WITHDRAWAL

  1. If the consumer has a right of withdrawal, this can only be excluded by the entrepreneur if the entrepreneur has clearly stated this in the offer, or at least in good time before the conclusion of the agreement.
  2. Exclusion of the right of withdrawal is only possible for products:
    1. that have been created by the entrepreneur according to the consumer's specifications;
    2. that are clearly personal in nature and intended for a specific person;
    3. that cannot be returned due to their nature, such as natural products like flowers, flower bulbs, seeds and plants, but also products containing natural fresh products such as dried flowers, Christmas wreaths, Christmas trees, reeds, branches, flower arrangements, funeral bouquets, funeral wreaths, and bouquets.
    4. that have been irrevocably mixed with other products after delivery due to their nature;
    5. that spoil or age quickly;
    6. whose price is subject to fluctuations in the financial market over which the entrepreneur has no influence;

  1. In addition, exclusion of the right of withdrawal is only possible for agreements:
  2. Where the consumer specifically requested the entrepreneur to visit them for an urgent repair and/or maintenance. Only additional services that were not explicitly requested and goods other than replacement goods for maintenance or repair cannot be excluded.
